Individual Note: 1. Muskoka Herald July 28 1892...."LEWISHAM.......Mrs. Kate Ruttan appeared before A. C. Fletcher, J.P. on the 11th of June, charged with undue severity in the whipping of Robert John Burnett. As no time was allowed her to engage a lawyer, Wm. Lowe, Reeve, kindly consented to act as counsel. Her innocence was fully proven by seven sworn witnesses, among whom were the school trustees. The prosecution produced no witnesses except the culprit, whom the parents affirmed was not right in the head. Mrs. Ruttan in her testimony, affirmed that the boy in question was the most sensible in the whole family. The boy when asked by Mr. Lowe, "Do you know when you are telling a lie, or telling the truth?" promptly responded "No Sir". It was proven from the testimony of fourteen pupils, sworn to by seven
witnesses that the boy when slightly whipped for malicious lying and obscene language, assaulted the teacher, nearly breaking her arm. Mr. Lowe elicited from two witnesses that the boy had attacked his own mother with an axe and draw-knife. The boy admitted this to be true, but the magistrate refused to accept this evidence as not being on the case, when another witness admitted he had not heard of this onset, it was instantly jotted down as evidence. One witness swore the culprit's brother was in the habit of giving the said Robert a periodical kicking which probably inflicted the marks said to be on the child's body. This evidence was also refused. One witness swore Mr. Burnett had ordered his children to assault the teacher if punished. Mr. Lowe in an eloquent closing address called attention to the fact that all evidence of this boy's viciousness was preemptorily rejected. Mr. Lowe is as keen as a Philadelphia lawyer, but the eloquence of a Demosthenes here, would have availed nothing, as a sentence of five dollars and costs were written out before the defence was concluded. Mr. Lowe in eluding to this, thanks the Lord for his good eye-sight. Mrs. Ruttan has the sympathy of the whole neighbourhood, who are justly indignant at this one-sided law-suit. The trustees, considering that the punishment afflicted on the boy was less than his offences merited, passed a resolution exonerating Mrs. Ruttan from all blame in the matter and expelled the said, Robert John Burnett from the school." Aspdia, July 4 1892
